These Terms of Service (\"Terms\") constitute a legally binding agreement between you (\"you\", \"your\", \"User\") and WESTBRIDGE SYSTEMS LTD (\"Our Story Haven\", \"we\", \"us\", \"our\") governing your access to and use of the Our Story Haven website, applications, products and services (collectively, the \"Service\").

By creating an account, purchasing a product, accessing the Service or otherwise using Our Story Haven, you agree to be legally bound by these Terms and by our Privacy Policy.

2. Purpose of the Service

Our Story Haven exists to help people preserve what matters most.

Through guided questions, artificial intelligence, digital storytelling tools and optional printed books, we help users document memories, family history, personal experiences and life lessons.

The Service may evolve over time as we introduce new features, products and technologies.

3. Eligibility

You must be at least eighteen (18) years old to create an account or purchase any product or service.

By using the Service, you represent and warrant that:

  • you are at least 18 years old;
  • you have the legal capacity to enter into this agreement;
  • the information you provide is accurate;
  • you will comply with these Terms and all applicable laws.

If you are using the Service on behalf of another person or organisation, you confirm that you have the necessary authority to do so.

4. Your Account

One of the core principles of Our Story Haven is simple:

Your memories belong to you.

You retain full ownership of all content that you create or upload, including but not limited to:

  • photographs;

  • documents;
  • family trees;
  • letters;
  • captions;
  • memories;
  • other personal content.

Nothing in these Terms transfers ownership of your content to us.

We do not claim ownership of your family's memories.

We do not sell your stories.

We do not publish your private content without your permission.

8. Licence Granted to Us

In order to operate the Service, you grant WESTBRIDGE SYSTEMS LTD a limited, worldwide, non-exclusive, revocable licence to:

  • host your content;
  • store your content;
  • process your content;
  • transmit your content;
  • display your content to you and those you authorise;
  • create digital books and printed products requested by you;
  • use artificial intelligence features that you choose to activate.

This licence exists solely for the purpose of providing the Service.

It automatically ends when your content is permanently deleted from our systems, subject to applicable legal retention requirements.

9. Artificial Intelligence Features

Our Story Haven includes features powered by artificial intelligence.

Depending on the services you use, AI may assist with:

  • transcribing audio recordings;
  • generating follow-up questions;
  • organising memories;
  • improving story structure;
  • generating suggested text;
  • preparing books for publication;
  • improving search and organisation within your private library.

AI is intended to assist you - not replace your own voice or experiences.

You remain responsible for reviewing all AI-generated content before publishing, printing or sharing it.

We do not use your private stories to train third-party artificial intelligence models.

10. Future Features

As Our Story Haven grows, we may introduce additional services, including but not limited to:

  • enhanced AI capabilities;
  • premium subscriptions;
  • additional storage;
  • backup services;
  • legacy planning tools;
  • collaborative family spaces;
  • integrations with third-party services;
  • mobile applications;
  • physical products;
  • premium publishing services.

Unless otherwise stated, these Terms will apply to such future features as well.

11. Acceptable Use

Our Story Haven is intended to be a safe and respectful platform for preserving personal stories and family memories.

By using the Service, you agree that you will not:

  • use the Service for any unlawful purpose;
  • upload content that infringes the intellectual property rights or privacy rights of others;
  • upload defamatory, abusive, hateful, discriminatory, violent or otherwise unlawful content;
  • upload malware, viruses or malicious code;
  • interfere with or disrupt the operation or security of the Service;
  • attempt to gain unauthorised access to any account, system or network;
  • scrape, copy, reverse engineer or otherwise attempt to extract the source code or underlying technology of the Service except where expressly permitted by law;
  • use automated systems to access the Service in a manner that negatively impacts its operation;
  • impersonate another individual or falsely represent your identity.

We reserve the right to investigate suspected misuse and to suspend or terminate accounts that violate these Terms.

12. Your Content

You are solely responsible for the content you upload or create using the Service.

You confirm that:

  • your content does not infringe any third-party intellectual property rights;

13. Copyright Complaints

14. Payments

Certain features of the Service require payment.

Prices are displayed before purchase and may vary depending on:

  • printed products;
  • shipping destination;
  • applicable taxes.

All prices are displayed in the currency shown during checkout.

15. Paddle as Merchant of Record

Payments are processed by Paddle, which acts as Merchant of Record.

This means Paddle is responsible for:

  • processing payments;
  • calculating and collecting applicable taxes;
  • issuing invoices where required;
  • complying with relevant payment regulations.

By completing a purchase, you also agree to Paddle's applicable terms and privacy practices.

We do not store your payment card information.

16. One-Time Purchases

Most products offered through Our Story Haven are sold as one-time purchases.

Unless expressly stated otherwise:

  • your purchase does not automatically renew;
  • no recurring payments will be charged;
  • your access continues according to the plan purchased.

17. Optional Subscriptions

Certain optional services may be offered on a recurring subscription basis.

Subscription pricing, billing intervals and cancellation terms will always be presented before purchase.

Cancellation prevents future renewals but does not normally affect access already paid for during the current billing period.

18. Backup Services

Our Story Haven may offer optional backup and storage services designed to provide additional protection for your content.

These services are optional unless otherwise stated.

Although we take extensive measures to protect your information, you acknowledge that no digital storage solution can guarantee absolute protection against every possible technical failure or event beyond reasonable control.

We encourage users to maintain their own copies of particularly important memories wherever possible.

19. Printed Books

Certain purchases may include professionally printed books.

Printed products are manufactured using the content that you approve before production.

You are responsible for reviewing all text, photographs and layouts before confirming a print order.

Once production has begun, printed products generally cannot be modified or cancelled except where required by applicable consumer protection laws or where a manufacturing defect exists.

Minor colour differences, trimming variations or other normal printing tolerances do not constitute defects.

20. Taxes

Where applicable, VAT, sales tax or similar taxes will be calculated during checkout.

Tax calculations are handled by Paddle in accordance with applicable legal requirements.

The amount charged at checkout represents the total amount payable unless clearly stated otherwise.

21. Refunds

Your statutory consumer rights remain unaffected.

Refund eligibility depends on the product or service purchased and is governed by our separate Refund Policy, which forms part of these Terms.

Where digital content has been accessed, downloaded or personalised, your statutory cancellation rights may be limited where permitted by applicable law and where you have expressly consented to immediate performance.

22. Intellectual Property

Except for the content that you create and upload, all intellectual property rights in the Service remain the exclusive property of WESTBRIDGE SYSTEMS LTD or its licensors.

This includes, but is not limited to:

  • software;
  • source code;
  • databases;
  • design;
  • branding;
  • logos;
  • trademarks;
  • graphics;
  • icons;
  • user interface;
  • artificial intelligence systems;
  • workflows;
  • written content;
  • documentation.

Nothing in these Terms transfers ownership of our intellectual property to you.

23. Licence to Use the Service

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable and revocable licence to access and use the Service for its intended purpose.

You may not:

  • copy the platform;
  • distribute the platform;
  • sell access to the platform;
  • sublicense the platform;
  • modify the software;
  • create derivative works based on the Service;
  • reverse engineer or attempt to discover the underlying source code except where such rights cannot legally be restricted.

Some export features may only be available for certain plans or products.

30. Account Deletion

You may request deletion of your account at any time.

Upon deletion:

  • your access to the Service will end;
  • your content will be scheduled for deletion in accordance with our Privacy Policy;
  • certain information may be retained where required by law or for legitimate legal purposes.

Deleted content may not be recoverable.

We encourage users to export important memories before requesting deletion.

During such events, our obligations shall be suspended for the duration of the event to the extent reasonably necessary.

Nothing in these Terms shall prevent us from improving, replacing or expanding the Service, provided that we continue to respect applicable consumer rights and any contractual obligations relating to paid services.

Our goal is to continuously improve the experience while preserving the trust that users place in us when sharing their life's most valuable memories.

35. Disclaimers

Our Story Haven is provided to help you preserve your memories, but we cannot guarantee that every possible outcome will be perfect.

While we strive to offer a reliable, secure and high-quality service, we do not guarantee that:

  • the Service will always be available without interruption;
  • every feature will operate without errors;
  • all content generated with artificial intelligence will be accurate, complete or suitable for your intended purpose;
  • every technical issue can be prevented or immediately resolved.

Artificial intelligence is designed to assist you - not replace your own judgement.

You are responsible for reviewing any AI-generated content before saving, printing, publishing or sharing it.

36. Limitation of Liability

Nothing in these Terms excludes or limits liability where such limitation would be unlawful, including liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation;
  • any rights that cannot legally be excluded under applicable consumer protection laws.

Subject to the above, and to the maximum extent permitted by applicable law:

WESTBRIDGE SYSTEMS LTD shall not be liable for:

  • indirect losses;
  • consequential losses;
  • loss of profits;
  • loss of business opportunities;
  • loss of goodwill;
  • loss of anticipated savings;
  • interruption of business;
  • loss of data where caused by factors beyond our reasonable control.

Our total liability arising from or relating to the Service shall never exceed the greater of: (a) the total amount paid by you to us during the twelve (12) months immediately preceding the event giving rise to the claim; or (b) GBP Β£100.

Nothing in this section affects your statutory consumer rights.

37. User Responsibility

You acknowledge that:

  • you are responsible for maintaining copies of particularly important content;
  • you are responsible for reviewing your own stories before publishing or printing;
  • you are responsible for deciding who receives access to your family memories;
  • you remain responsible for complying with applicable laws when uploading content.

Although Our Story Haven offers secure storage and optional backup services, no digital platform can eliminate every possible risk of data loss.

38. Indemnification

You agree to indemnify and hold harmless WESTBRIDGE SYSTEMS LTD, its directors, employees, contractors and affiliates against any claims, damages, liabilities, costs or expenses arising from:

  • your breach of these Terms;
  • unlawful use of the Service;
  • infringement of third-party rights;
  • content uploaded by you that violates applicable law.

This provision applies only to the extent permitted under applicable law.

39. Modifications to the Service

We may modify the Service from time to time, including:

The updated Terms become effective on the date stated at the top of the document.

Continued use of the Service after that date constitutes acceptance of the revised Terms.

These Terms shall be governed by and interpreted in accordance with the laws of England and Wales.

Nothing in these Terms limits any mandatory consumer rights that apply under the laws of your country of residence.

42. Dispute Resolution

If we cannot resolve the dispute informally, either party may pursue available legal remedies under applicable law.

Subject to mandatory consumer protection laws, disputes shall fall within the jurisdiction of the courts of England and Wales.

Any invalid provision shall be interpreted, where possible, in a manner that most closely reflects its original purpose while remaining legally enforceable.

44. Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy, Cookie Policy, and any additional policies expressly incorporated by reference, constitute the entire agreement between you and WESTBRIDGE SYSTEMS LTD regarding your use of the Service.

They replace all prior discussions, understandings or agreements relating to the Service.

45. Assignment

We may transfer or assign our rights and obligations under these Terms in connection with:

Such transfer will not reduce your statutory rights.
